Women Allege Unauthorized Use of Personal Information by Online Business


MEMPHIS, Tenn. (WMC) – There have been dozens of calls and complaints concerning a Memphis business that’s actually not in Memphis at all–and it may not even be a real business.

Action News 5 is investigating an online retailer selling faith and freedom this holiday, hiding behind the very real identities of two local women.

For Susie Webber, fashion is her passion. As owner of the Envy Chic Couture Boutique, she not only sells the latest trends, but also models them.

“That’s the thing that I love the most, I’m able to model the clothing, I really, really love clothing, and I can dress them up and make them cute,” she said.

Webber opened her store on Park Avenue in Orange Mound five years ago, a location it turns out that apparently caught the envy of others.

“They gave me the address and I’m like, ‘yes that’s my address, but I don’t know these people,’” said Webber.

Those people are with a company called USA Comfy Cloths, an online retailer selling clothes proudly made in the USA.

If you can put a flag on it, the site sells it, promising, “no matter what product, it can provide convenience for you.”

On Facebook, the company conveniently lists its location as 2276 Park Avenue, ZIP Code 38114.

The problem is that’s Webber’s address. She doesn’t sell star-spangled shirts or patriot pullovers.

“Yeah, that’s not me. I don’t know them at all,” said Webber.

“I do not believe it is a mistake on the company’s part,” said Daniel Irwin with the Better Business Bureau.

Daniel Irwin with the Better Business Bureau started getting calls and complaints months ago from unhappy USA Comfy Cloths customers claiming the company didn’t deliver designs as promised.

“They’re either telling us one or two things. A) they’ve never received any merchandise or B) they did get something, but it was a cheap knockoff from a foreign country and not what they ordered,” said Irwin. “It’s using that patriotism as an appeal for your money and when in reality, especially in this case, that doesn’t seem to be the case.”

So, the BBB tried tracking them down, only to discover USA Comfy Cloths was not only using Webber’s Memphis address as a cover, but also another local woman’s phone number as a contact.

“I don’t know how my number ended up on this website, but I have nothing to do with this,” said a woman who said her phone number is being used.

She asked us not to show her face or use her name, but is not in the business of firework frocks and bandana-wearing bald eagles. But, USA Comfy Cloths lists her phone number as their business line.

She said it’s been frustrating.

“You have no idea. It has been awful. They call all hours of the night, in the morning,” she said. “Every morning, I get over 6-7 calls maybe more. At least three months or longer that these calls have been coming to my phone.”

The caller complaints mirror those posted online, saying things like:

“Obviously an overseas company using a name designed to fool people.”

“The company advertises that they are an American company, but that is not true.”

“Ordered items more than a month ago and haven’t received them yet.”

“One lady said they charged her card twice, one said they did hers three and one said he ordered something for his wife, and it was like in March, and he still hadn’t received it.” the woman said.

The BBB says the company’s website and Facebook page are full of red flags. On top of the wrong address and phone number on Facebook, the actual website doesn’t even list contact information, other than a generic email. There’s no secure checkout, poor grammar, and Asian script.

So why pick an address in Orange Mound as your physical location?

“I think in this particular circumstance they’re just using the name of real business that make clothes to make it sound more believable,” said Irwin.

Credibility is something Susie Webber spent years building at her real business, expanding her retail space with the help of the city’s economic development agency.

“Being that the economy is the way that it is, reputation is everything,” said Webber.

The last thing she wants is to have to deal with angry customers who were never really her customers at all.

“Just stop it. And why would you use my address? We’re a legit business. We’ve been established for a very long time. Please get your own address and please get your own telephone number,” said Webber.

So both women can free themselves for things that really matter.

“I haven’t changed my phone number for the simple fact that I have health issues, my husband has health issues. It’s too many people to get a new number out to that need to contact me,” the woman said.

Action News 5’s Jerry Askin tried to talk to someone with USA Comfy Cloths, but other than the address in Orange Mound and the other lady’s phone number, there’s only a customer feedback email. He never got a response.

Bottom line, according to the BBB, do your research when shopping online.
