Elon Musk faces a second lawsuit over $1 million election giveaway

Elon Musk is currently facing another lawsuit surrounding the $1 million voter lottery organized by his political action committee America PAC. His defense against the initial lawsuit seems to have fueled the filing of a second one.

Submitted to a Texas District Court by an Arizona resident on Tuesday, the new 14-page class action lawsuit alleges Musk and America PAC of fraud and breach of contract in relation to the $1 million giveaway launched last month.

Accessible to registered voters in seven swing states, including Pennsylvania, Georgia, Nevada, Arizona, Michigan, Wisconsin, and North Carolina, Musk’s $1 million daily giveaway required participants to provide personal information and sign a petition supporting the First and Second Amendments. Each signatory was offered $47 by Musk and America PAC as a token of appreciation for their support. Additionally, signees were entered into a random draw to win $1 million daily starting from Oct. 19.

The recent class action lawsuit argues that the selection of $1 million winners was not random, as claimed, and that Musk and America PAC made false statements to encourage petition signatures.

Referring to a previous case brought by Philadelphia’s district attorney Larry Krasner regarding Musk’s giveaway, the lawsuit accuses Musk and America PAC of running an illegal lottery, trying to influence voters, and contravening consumer protection laws with deceptive statements.

Musk’s lawyer Chris Gober has stated, “The $1 million recipients are not chosen by chance. We know exactly who will be announced as the $1 million recipient today and tomorrow.”

A judge ruled in favor of Musk on Monday, allowing the America PAC giveaway to continue. However, revelations during the case contradicted public claims made by Musk and America PAC, sparking the new class action lawsuit the following day.

The lawsuit alleges that the promises of random $1 million winners were false and knowingly deceptive. It also requests at least $5 million in damages and the deletion of all personal information collected from participants in the giveaway.

An NBC News report revealed that the initial winners of the $1 million lottery had political leanings favoring Republicans, raising questions about the fairness of the selection process.

Musk, a known supporter of Trump, has denied allegations of bias in the selection process, claiming that individuals from any political background had a chance to win. However, the statistics on actual winners suggest otherwise.
