Which ICC Countries Could Netanyahu and Gallant be Arrested in for Israel-Palestine Conflict?

Enforcement of the arrest warrants issued by the International Criminal Court (ICC) is mandatory for over 120 countries that are part of the court.

Israeli Prime Minister Benjamin Netanyahu and his former Defence Minister Yoav Gallant are now considered fugitives from justice following the issuance of arrest warrants by the International Criminal Court (ICC) for suspected war crimes in Gaza.

Although Israel does not acknowledge the authority of the ICC and Netanyahu and Gallant have not surrendered themselves, their options have significantly narrowed.

As per the Rome Statute, which established the ICC, there are 124 state parties spanning six continents. These countries are legally obligated to implement the arrest warrants of the ICC, as explained by international human rights lawyer Jonathan Kuttab.

“The law operates under the assumption that people will adhere to it. This is the foundation of all laws,” Kuttab stated in an interview with Al Jazeera. “Everyone is expected to respect the law. Those who fail to do so are in violation of the law.”

It has been observed that many countries are not disregarding the court’s decision. Numerous of Israel’s allies, including the European Union, have committed to upholding the arrest warrants, Kuttab highlighted.

Despite Netanyahu’s denial of the charges and labelling them as anti-Semitic, the predicament for both him and Gallant remains precarious.
