While major commission settlements received final approval on Tuesday, new filings in ongoing cases serve as a reminder that the National Association of Realtors’ approval is not the final verdict.
An amended complaint filed in the Batton II case on Tuesday added 22 new homebuyer plaintiffs from 19 states, bringing the total to 32 plaintiffs. This filing ensures that the case will proceed with additional plaintiffs included.

The final settlement approval on Tuesday resolved antitrust claims by homesellers in cases like Sitzer | Burnett and Moehrl, alleging an illegal conspiracy to inflate broker commissions by NAR and other major real estate companies.
However, settlements with homesellers do not protect against lawsuits filed by homebuyers, as seen in cases like Batton II with claims of inflated home prices and broker commissions.
The ongoing legal challenges faced by NAR and industry players indicate that the settlement is not the end of legal action.
Other updates
Real estate firms like eXp and Weichert have reached settlement agreements in cases like Hooper, but legal challenges persist as objections are raised, delaying final approvals.
The legal landscape for the real estate industry remains complex, with ongoing investigations and lawsuits affecting major players in the market.
