The Department of Education under President Donald Trump announced on Friday that K-12 schools and higher learning institutions will recognize Title IX protections based on biological sex, reversing former President Joe Biden’s 2024 revision.
According to a press release, the “Dear Colleague” letter reinstates the 2020 Title IX rule from the Trump administration, providing more robust due process protections for students during Title IX proceedings and safeguarding campus free speech.
Craig Trainor, acting assistant secretary for Civil Rights during the Trump era, condemned Biden’s attempted rewrite of Title IX as unlawful and harmful to women and girls. He emphasized the Education Department’s commitment to upholding equal opportunity for all, particularly safeguarding the rights of women and girls in educational settings.
Federal Judge Rejects Biden Administration’s Title IX Rewrite
Title IX prohibits discrimination based on sex or gender for federally funded entities.
Under Biden’s 2024 interpretation, “sex” was expanded to include gender identity and sexual orientation.
U.S. District Court Judge Terry Doughty granted a preliminary injunction against Biden’s Title IX revision, criticizing the abuse of executive power in rulemaking. Chief Judge Danny Reeves later struck down the rewrite, emphasizing that “discrimination on the basis of sex” refers to being male or female.
