The National Association of Realtors suffered a legal setback as the U.S. Supreme Court declined to hear its case against the Department of Justice.
The Supreme Court’s decision, without explanation, now allows the Department of Justice to resume its investigation into the association’s controversial commission and pocket listing rules.
“While the Supreme Court chose not to review the lower court’s decision, NAR remains dedicated to advocating for the interests of its members and the consumers they serve,” a NAR spokesperson told Inman.
The path forward for NAR is uncertain, as the case returns to the district court where NAR’s petition to pause or modify the investigation was initially filed.
